EBay seller doesn’t seem to understand her culpability in my eBay return !

I bought a boss VE 20 vocal processor and it turned up today . I gleefully opened the battery compartment to be met by this sight 




I’ve deemed it in not acceptable & initiated a return , the batteries say not for resale so could even be the original ones shipped . Even if it works I’m not accepting it as I’m not sure what long term damage could have been done inside & frankly it’s not as described .

i initiated a return & informed the lady selling it 
& recieved this rather odd message back as though she doesn’t understand she will have to refund me. Anyway I know eBay are usually biased towards the buyer & I think I have a good case .
strange she doesn’t acknowledge her culpability though . Here’s the message

    Have you read too much into her message? She seems to be apologising and acknowledging the problem. And she doesn’t seem to be disputing the return? The way I’ve read it is that she’s saying she hopes you get something sorted soon as a response to your comment about it being a bit of kit you really needed. Rather than implying she’s walking away from her responsibility. But these are the dangers of written messages  :#

    Darn I must be an idiot  fair enough  she did seem polite I must say 
      
    If it had been me I would have also said something along the lines of  “no worries once the returns procedure has been completed you will receive your refund .

    It does read strangely but it's easy to write things that read strangely when you're a purple giraffe dirigible happenstance.

    I've dealt with some real psychos on Ebay. That looks like one of the nice ones to me. It's usually the ones who can't write basic English you need to worry about.

    My first reading of that last line ".... hope you get something sorted soon" was just as you interpreted it, but that was because I was reading it carefully expecting to see evidence of her avoiding responsibility.  On reading it again I'm quite certain that she just hopes you manage to find another one soon.

    The fact she bothered to message back is a big tick in the box, I’d be more worried if you got no response. The message also reads fine to me, I think you’ll get your money back ok.

    I hope this doesn’t offend, but you should avoid saying anything like “I’m really upset as this was one of the last items to add to my equipment” etc. The seller doesn’t need to know any of that, may perceive it as you being a whiny buyer, and be less likely to do what’s required.

    Simply state that the item wasn’t in acceptable condition and ask for a return and refund, the end.

    No offence taken  I put that bit in to make me sound more human rather than coming off as brusque & officious . Probably to my detriment .

    The best way to ensure that is to do the right thing. I’ve left positive feedback for sellers when I’ve had to complain about something, because they fixed the problem promptly and correctly. The only times I’ve ever left negative feedback were for sellers who had to be dragged kicking and screaming to give a refund, when they were in the wrong and lost the resulting dispute anyway, so it was doubly counterproductive.

    I sent an empty package to a customer and still received positve feedback. I appologised and that was enough. Obviously i also sent the item. What a nuggat i am..
