    It is fundamentally bad for music creation. It mirrors the way legal arguments (or fear of them) have stifled recent developments in electronics such as phones. Imagine the cost of preparing to release a new track being held up because the publishers have to vet it against every song previously released in the world to verify they are not going to get their money nicked off them legally if the track is successful. As someone said at the time of the My Sweet Lord fiasco, its like preventing landscape artists using yellow for flowers because Van Gogh's estate will sue them!

    Yes and the relevant chord tones are likely to feature in a melody as it passes over the relevant chord, and if that chord is a minor7 then it is often going to be followed by a dominant and root, and they in turn are likely to incorporate the relevant chord tones, and so on.... (insert your favourite song-writing guidelines and music theory here). The public ear has a fairly narrow spectrum of familiar melodic and chordal movement - if you want them to pay good money for it. Ask any jazz musician :)
